1. General<\/strong><\/h4>\n\n\n\n

1.1 These terms and conditions apply exclusively to all services offered by Kongin Online. Deviating agreements are only valid if accepted by us in writing.
1.2 Our service descriptions on this website are non-binding and subject to change. Kongin Online reserves the right to modify, add to or remove any part of its offering without prior notice.
1.3 The client accepts these terms and conditions upon acceptance of our services.<\/p>\n\n\n\n

2. Orders & Contracts<\/strong><\/h4>\n\n\n\n

2.1 All offers are non-binding. Orders are only binding upon written confirmation by Kongin Online. The written order confirmation is decisive for the content and scope of the contract.
2.2 Contracts can be concluded in German, English or Thai.
2.3 The client is responsible for the accuracy of all information and materials provided to Kongin Online for the purpose of fulfilling the order.<\/p>\n\n\n\n

3. Cancellation of Services<\/strong><\/h4>\n\n\n\n

3.1 National services must be cancelled at least 24 hours before the scheduled start. Late cancellations will incur a cancellation fee of 50% of the calculated service value (minimum 2 hours).
3.2 International on-site services must be cancelled at least 30 days before the scheduled start. Late cancellations will incur:<\/p>\n\n\n\n

  • 50% of the calculated time expenditure (minimum 24 hours)<\/li>\n\n\n\n
  • Full reimbursement of all preparatory expenses already incurred<\/li>\n\n\n\n
  • Full reimbursement of additional personnel costs<\/li>\n\n\n\n
  • Full reimbursement of travel costs including flights, hotels and vehicle rentals if already booked<\/li>\n<\/ul>\n\n\n\n

    4. Delivery & Performance<\/strong><\/h4>\n\n\n\n

    4.1 Delivery periods are approximate unless expressly agreed in writing. Deadlines require prior written clarification of all facts necessary to fulfil the order.
    4.2 Delivery times may be extended due to circumstances beyond our control including operational disruptions, strikes or other unforeseeable obstacles.
    4.3 In the event of a delay the client will be informed within 48 hours. If a reasonable grace period set by the client expires without resolution, the client is entitled to withdraw from the contract.<\/p>\n\n\n\n

    5. Prices & Payment<\/strong><\/h4>\n\n\n\n

    5.1 All prices are net prices excluding applicable taxes unless otherwise stated in writing.
    5.2 Payment terms are agreed individually per project and confirmed in writing. Depending on project scope, the following models apply:<\/p>\n\n\n\n

    • Full advance payment before project start<\/li>\n\n\n\n
    • Partial advance payment with final payment upon completion<\/li>\n\n\n\n
    • Monthly invoicing for ongoing services<\/li>\n<\/ul>\n\n\n\n

      5.3 Invoices are due immediately upon receipt without deduction unless otherwise agreed in writing. In the event of late payment exceeding 14 days, interest may be charged at standard bank rates.
      5.4 Accepted payment methods: bank transfer (SWIFT), advance payment. Other methods by written agreement.<\/p>\n\n\n\n

      6. Third-Party Products & Partner Tools<\/strong><\/h4>\n\n\n\n

      6.1 Kongin Online may offer or resell software tools and developments from trusted partner companies including KyotoTech LLC, Japan.
      6.2 For third-party products, the licensing terms and conditions of the respective manufacturer apply in addition to these terms.
      6.3 Kongin Online provides no warranty for third-party software beyond what the manufacturer provides. Any defects in third-party products must be reported to the manufacturer directly.<\/p>\n\n\n\n

      7. Warranty & Liability<\/strong><\/h4>\n\n\n\n

      7.1 Kongin Online provides services in accordance with the current state of the art. Written quality guarantees are only valid if expressly confirmed in writing.
      7.2 Warranty claims expire 6 months after completion of the service. Defects must be reported within 14 days of discovery.
      7.3 Liability is limited to intent and gross negligence. Kongin Online accepts no liability for consequential damages arising from the use of its services unless caused by willful misconduct.
      7.4 The client is responsible for maintaining appropriate data backups. Kongin Online accepts no liability for data loss during service delivery.<\/p>\n\n\n\n

      8. Copyright of Deliverables<\/strong><\/h4>\n\n\n\n

      8.1 All documents, designs, code and other materials created by Kongin Online remain the intellectual property of Kongin Online until full payment has been received.
      8.2 Upon full payment, usage rights are transferred to the client as agreed in the individual contract.
      8.3 The client is responsible for ensuring that all materials provided to Kongin Online for use in deliverables (texts, images, logos) are free of third-party rights.<\/p>\n\n\n\n

      9. Data Protection<\/strong><\/h4>\n\n\n\n

      The processing of personal data in connection with our business activities is carried out in compliance with applicable data protection law including GDPR and Thailand’s PDPA. Details are set out in our Privacy Policy.<\/p>\n\n\n\n

      10. Place of Performance & Jurisdiction<\/strong><\/h4>\n\n\n\n

      10.1 The place of performance for all services is Nakhon Sawan, Thailand.
      10.2 The place of jurisdiction for all disputes is the competent court in Nakhon Sawan, Thailand.
      10.3 Should individual provisions of these terms be or become invalid, the remaining provisions remain in full effect.

      The invalid provision shall be replaced by one that comes closest to the intended commercial purpose.<\/p>\n\n\n\n
